Venue Agreement

 

In the following agreement, “we”, "our", “performer(s)” refers to Max Rathbone and Mel Gipson, member of Fierce Progression. “You”, "your", “venue” refers to the signer of this agreement, the venue management, show promoter, and/or production team to which this agreement applies.

 

Performer(s) Requirements:

 

Ø      Adhere to all of the statements set forth in this agreement.

Ø      Deliver a fire performance per the agreement specifications to the best of our ability.

Ø      Follow all safety protocols set by our safety checklist, the venue and area fire departments.

 

Venue Requirements:

 

Due to the specific nature of the performance we request that you inform us of the inclusion of other fire performers in your event at the time of the contract signing so as to present as unique and enjoyable a show as we can with the help of the other performers.

 

I.  VENUE LOCATIONS

A minimum clear area for the audience from the performance area is 10-15 feet and is required when any open flames are present. This will be enforced by the venue, unless otherwise stated in the agreement.

 

A.     Outdoor Events

1.      A 15 square foot performance area is required, but negotiable

2.      If musical accompaniment is required for the show, you are to provide an appropriate sound system, which will be loud enough to reach the performance area and be heard over the roaring of the flames. Music is not required for a performance however betters the appeal of the show.

 

B. Indoor Events

1.      All overhead obstacles must be no closer than 10 feet from any open flames this includes stage curtains, scrims, lighting and sound equipment.

2.      A performance area of 10 square foot if required, but is negotiable.

3.      Proper ventilation is required. Smoke alarms and other fire safety devices near the performance area must be checked by the local fire department, to be certain they will not go off during the show.

 

II. FIRE PERMITS

All indoor performance areas must be approved by a member of the fire department. If the venue has not already been inspected for fire performances by the fire department, you will need to arrange a date and time for the inspection of the venue in person, with a member of the local fire department. The cost of the permit will be covered by the venue at no deduction from our rates. This contract does not bind us to obtaining the permits. It is the venue’s responsibility to ensure that all safety rules and regulations are followed.

 

If a problem arises with any of the above mentioned items that could possibly endanger the fire performer, the audience, or any equipment it is the venue’s responsibility to resolve the issue. If the issue is not resolved in a satisfactory manner, we reserve the right to cancel the performance.

Note: We cannot and will not be held responsible for anyone not listed at the top of this agreement.

 

III. CANCELLATIONS

Weather can affect outdoor fire performances tremendously. Wind, thunderstorms, snowstorms and such weather conditions pose potential hazards. If we feel that the weather is not conducive to a safe fire performance we reserve the right to adjust the performance contents accordingly. This includes substituting flags, or chemical lights for fire tools or performing with fire tools covered and unlit.  

 

§         If we cancel an event at least 5 business days in advance of the performance date the venue will receive a full refund of any payments rendered. Cancellations occur only during incidents of extreme illness or death.

 

§         We require 10 business days for any venue cancellation. After the 10th business day we are entitled to half of the agreed upon payment.

 

If any of the above safety or venue terms are not met to our satisfaction or fixed to meet our satisfaction on the date of the event, we reserve the right to cancel a performance and to be entitled to 50% of the fee set forth in this agreement.  We are flexible where possible, and will inform you of any unsatisfactory conditions.

 

IV. RATES

Rates vary depending on your specific needs, but begin no lower than $75 per person for double performers or $100 for single performers. All shows can be customized to fit a venue, upon discussion and approval by the performer(s). If you choose to include fire breathing in the performance, an additional fee of $50 will be incurred by the venue for the increased health risk. Rates and Payment are negotiable. Payments are to be made in bank check, money order, business check or cash only. No credit or personal checks can be accepted. Payment will be rendered to the performer(s) on or before the date of the event. If the show is to be an indoor event the venue is expected to pay fuel expenses. (Approx $5/show)

I have read and agree to adhere to all previous statements.  Signing this document legally binds the performers stated at the top of this agreement to performing at your event/venue and the venue responsible for all items per the specifications written above.
